Representative Experience

bullet

Administrative Hearings.  Our firm has engaged in many administrative hearings involving third party payer audits and licensing of health care professionals under the Michigan Public Health Code. We have a successful track record in obtaining dismissals of Administrative Complaints against our clients in appropriate cases. We also have obtained discharges and substantial reductions of refund demands from Medicare, Medicaid and Blue Cross by raising critical legal defenses in third-party payer audits.

bullet

Hospital Peer Review Panels Our firm has engaged in numerous staff privileges cases involving physicians who have faced potential termination or nonrenewal of their hospital staff privileges. Our firm has achieved successful results by vigorously defending allegations and insisting on the procedural protections under the Health Care Quality Improvement Act governing these proceedings. As a result of our efforts, many of our clients have maintained their hospital staff privileges.

bullet

Arbitration and Facilitation.  Our firm has successfully represented clients in arbitration proceedings, conducted much like an in-court trial but in a private setting. We have also represented clients in private facilitations of legal disputes, leading to resolutions and settlement agreements at lower cost than lawsuits.

bullet

Credentialing Bodies Our firm has appeared before several third-party payer credentialing bodies to defend disaffiliation of our clients from third-party payer programs. We forcefully demand that credentialing bodies adhere to participation guidelines and other statutory requirements in departicipation proceedings. We have obtained successful results for our clients including the reinstatement of our clients to third-party payer programs and the removal of adverse reports from the National Practitioner Data Bank as a result of departicipation proceedings.

bullet

Trials.  Our firm has engaged in state and federal court cases involving non-compete disputes, shareholder lawsuits, and other business lawsuits involving health care professionals. Our firm has achieved successful results through summary dismissals based on prehearing motions and vigorous prosecution and defense of claims. Our clients have also received significant damage awards either through trial or settlement.

bullet

Appeals.  Our firm has successfully conducted appeals on behalf of our clients in connection with licensing proceedings, administrative hearings, and circuit court and federal court proceedings. Our appellate briefs are of the highest quality. Legal issues are carefully analyzed, researched and well-written. We have obtained appellate victories including transfer of cases to more favorable venues, reversal of adverse trial decisions, and affirmation of favorable administrative decisions.
